Presidency Shocked, Rattled As Abuja Court Throws Out Buhari’s Application in Certificate Case
SignalNG - The Honorable Justice Ademola Adeniyi sitting at the Federal High Court 7, Abuja on Thursday 26th, May 2016 dismissed the Preliminary Objections filed by President Muhammadu Buhari in the case instituted against him, the Independent National Electoral Commission (INEC) and the All Progressives Congress (APC) in Suit No. FHC/ABJ/CS/110/2015 by an Abuja based Legal Practitioner, Barr. Nnamdi Nwokocha-Ahaaiwe challenging his competence to stand election into the office of President of the Federal Republic of Nigeria when he lacks the basic educational qualifications set out in the Constitution.

The development has reportedly thrown the Nigerian presidency into disquiet as President Buhari and his handlers greeted the ruling with shock, as very few Nigerians including members of Buhari’s government realized the case was still in court.

According to an informed source on the development, the ruling has caught the Buhari presidency unawares and has posed a big distraction for government activities at the Villa. “Nobody even knew the case was still on. The story was not even reported in the mainstream media. No paper carried the Thursday ruling. But I can tell you the Presidency is rattled and seriously hoping that the case does not resurface again in the public domain because of the huge embarrassment it could cause the President. But more importantly, there are concerns about the safety of the judge and the plaintiff”, the source disclosed.

Recall that in February 2015, Nnamdi Nwokocha-Ahaaiwe, Esq. filed an Originating Summons at the Federal High Court, Abuja praying the Court to among others declare that Buhari is unqualified to aspire to the position of President not having sat for the Secondary School Certificate and also deposing to a false affidavit about his educational qualifications contrary to the Electoral Act.

Buhari and the APC instead of entering a defence on the merits and exhibiting any educational certificates obtained by Buhari, tried to frustrate the hearing of the case by filing several objections to the competence of the action.

President Buhari reportedly retained over twenty SANs led by Chief Wole Olanipekun, Chief Akin Olujinmi, Femi Falana, etc., who for over one year now have failed to file any defence for Buhari or APC but instead used every trick in the book to delay the case.

But on Thursday, the Hon. Justice Ademola Adeniyi in his ruling on the case, dismissed all applications by the defendant as totally lacking in merit. He held that the suit filed by Nnamdi Nwokocha-Ahaaiwe was competent and the service on Buhari and APC was also competent.

He thereafter adjourned the case to the 16th day of June 2016 for hearing of the substantive Originating Summons to determine whether Buhari’s educational qualifications meets the minimum standards required by the Constitution.

According to reports made available to SIGNAL, only the counsel to INEC was in Court, the plaintiff was absent but wrote to the Court explaining that he received notice of the date for the ruling the previous night and was out of town and could not make it. APC (2nd Respondent) and Buhari (3rd Respondent) were absent, were not represented and did not write to Court.

It will be recalled that there were claims by online handlers of the All Progressives Congress (APC) that the Nigerian Army  located President Buhari’s “missing certificate” after the elections. The missing certificate saga raised contention as to the eligibility of Buhari to contest the presidential election. However, it is on record that there was no official statement by the Nigerian Army up till this day corroborating claims that the certificate has been found.

One Party, 3 Chairmen CRISIS: PDP NASS Lawmakers Set To Defect To APC Massively As Pressure Mounts
The opposition Peoples Democratic Party National Assembly members may massively defect to the ruling All Progressives Congress over unending crisis ravaging the party that has produced three chairmen running parallel affairs of the party, News Punch has learnt

The party report says is now at the risk of losing most of its elected members at both chambers of the National Assembly especially from the non-PDP controlled states to the All Progressive Congress (APC) if it failed to find an amicable resolution to its crisis, report according to Nigerian tribune suggests

The chieftains of the ruling party are already in serious talks with lawmakers in both chambers of the National Assembly on the need for most of them to dump the former ruling party with assurances of several offers, including automatic ticket to return in 2019 general elections, Tribune reported

According to our source the most targeted states are Anambra, Lagos, Edo Kogi, Benue, Nasarawa, Plateau, Yobe, Adamawa, Kaduna, Ogun, Oyo and Osun.

It was gathered that following the three divisions that emerged in the Party on last Saturday, APC leadership reportedly directed its leaders in the affected states to everything possible to bring the PDP lawmakers into its fold since the electoral law allows defection once there is a division within a political party without losing one's seat.

A member of the PDP in the National Assembly who confirmed this development to the Nigerian Tribune in Abuja yesterday said that this might forced the party members  to come together to resolve their   problems

"The pressures are just too much; the leaders of the APC are mounting serious pressures on us to come over to them, following the latest development in our party, the pressures are coming with various promises and am afraid some of our members may bow to the pressures since they will have nothing to lose," the source.

According to our source, "we cannot continue to waste our time and resources; we are tired of the ending crises, there are factions here and there in all the states and the zone and all fighting for selfish interests, we thought the coming of Senator Ali Modu Sheriff would unite the party but alas, look at what is happening now, PDP is supposed to be providing a credible opposition to the ruling APC.

This came just as the National Secretariat of the former ruling Party, popularly known as "WADATA Plaza" in Abuja remained sealed on the orders of the Inspector General of Police, Mr Solomon Arase.

The Plaza was sealed off in the early hours of Sunday, following the three divisions that emerged in the Party on Saturday with the three factions threatening to take over the party secretariat on Monday.

The road leading to the Plaza were barricaded with two trucks belonging the Nigeria Police Force, while the staff of the secretariat, journalists and visitors were politely turned back by the stern looking mobile police personnel.

The staff and journalists covering the party were seen in groups discussing the lasted development in the Party.

The Caretaker Committee headed by the former Haduna State governor, Senator Ahmed Markarif, put in place at the Port-Harcourt convention to oversee the affairs of the party did not show up as expected while the Ali Modu Sheriff-led National Working Committee, which rejected the Caretaker Committee and vowed to take over the secretariat was said to be attending a crucial meeting at a location in the city and the third faction led by Senator Ibrahim Mantu was nowhere to be found.

As at press time, the Board of Trustees of the party was said to be meeting on the crisis in the Party

Buhari Shuns APC's List on Board Appointments

Buhari Shuns APC's List on Board Appointments

New Telegraph - The Presidency might have dropped the list of people submitted to it by the leadership of the All Progressives Congress (APC) for board appointments. The move came months after the leadership and members of the party had waited for the appointments.

It was learnt yesterday that the Presidency has begun a fresh compilation of names. A source within the party yesterday told New Telegraph that the Presidency has set aside the earlier list compiled by the leadership of the party.

According to him, the presidency discovered that there were sharp practices in the compilation. Over 2,000 names were nominated for board appointments by a committee that had all the APC National Vice Chairmen as members.

Also, five members of APC from each state were nominated as Chief Executive Officers of parastatals and agencies of Federal Government. A source at the National Headquarters of the APC in Abuja told New Telegraph that the Presidency had rejected the list compiled by the committee.

The source said: “Yes, the president has rejected the list compiled by the national leadership of the party and asked the Office of the Secretary to the Government of the Federation (SGF) to compile a fresh list.

The Presidency noticed that there were sharp practices in the compilation made by the committee and decided that the list should be dropped.” When the office of the SGF was contacted, a source admitted that they were compiling a fresh list of party members for the board and chief executive appointments.

Asked when the Presidency would release the board appointments, the source said: “We are still compiling the names of nominees.” Also, the source revealed that the merger of some ministries would also affect the release of the list as the Presidency was considering merger of some agencies and parastatals. “Until this is done, the list might not be released,” the source said.

Fuel Price Hike: Tinubu, Falana In Sharp Disagreement

Fuel Price Hike: Tinubu, Falana In Sharp Disagreement

Following the outright removal of the petroleum products subsidy by the federal government, which has already ushered in another fuel price regime in Nigeria, there arose a sharp disagreement between a former governor of Lagos State, Asiwaju Bola Ahmed Tinubu, who is also a national leader of the ruling All progressives Congress, APC and a renown Lagos based Human Right Lawyer and activist, Chief Femi Falana.

Tinubu described the decision of the President Buhari-led Federal Government to remove petrol subsidy as courageous.

Tinubu air his view vis a statement in Lagos on Thursday, said though the decision was a difficult one, it would ultimately become beneficial to the generality of the people instead of enriching the pockets of a few Nigerians, who enjoyed the fraud of the subsidy regime.

In furtherance of his argument, Tinubu, however, said that the subsidy regime on petrol had been bastardised beyond redemption, saying it would be a waste of time to attempt to sanitise subsidy payments.

The ex-governor added, “The president’s decision to reallocate funds once earmarked for the fuel subsidy and commit those funds to other more socially productive services and undertakings was a difficult decision. It was also a necessary one.

“Over the years, the operation of the measure was distorted to where it no longer functioned for the benefit of the masses but for the undue enrichment of a small club of businessmen, some legitimate in their work, some not.

“Instead of remaining a positive aspect of the social contract, the subsidy was transformed into an opaque haven of intrigue and malfeasance. It was turned into a shadowy process from which the unscrupulous extracted large sums of money without providing the services and products duly paid for. Fake businessmen became true billionaires over- night as if by supernatural force.

“To allow this unfairness to continue would have been a breach of the promise made by this government to the people.”

Tinubu added that the way out of the fraud inherent in the payment of subsidy on petroleum products was to end it altogether.

He stated, “It became a weapon of profiteering. The machinery of the subsidy had become so polluted that it was no longer feasible to talk about reforming it. Either it had to cease or we would have to surrender to the corruption now inherent in it.

“President Buhari has, with this decision, put an abrupt and just end to this assault against our economy and political system. He has made a courageous and prudent decision. It is time to end the fuel subsidy and to begin to subsidise the true needs of the people.
“To Mr. President, I say congratulation for having the courage to remove the subsidy.”

The ex-governor added, for some time, I have been a proponent of this action. I believed ending of subsidy was the only sure way to put to sleep the myriad demons that had invaded the subsidy process, sucking the blood of Nigeria, swallowing much of our needed money.’’
He argued that the action would put an end to agonising queues at filling stations while some unscrupulous businessmen’s bank accounts swelled at the detriment of the people.

The APC national leader said the current situation would also attract investors to the sector.

“Nigeria has taken the historic step needed to create a competitive environment that will eliminate smuggling, provide incentives for private refineries and attract foreign investments in the downstream sector and create employment,’’ he stated.

Tinubu admitted that the removal of subsidy meant “higher fuel costs generally”, saying, “I would be lying if I said this will cause no pain or dislocation.”

He noted that the President did not end the subsidy regime essentially to save money but “for the nobler purpose of putting those same funds to fairer, more equitable use in order that government might better serve those of us who are truly in utmost need.”

The APC chief added, “Thus, I ask everyone to take a step back to coolly and objectively assess what has been decided.

“We must not make the mistake of allowing our political and sympathetic attachment to the subsidy blind us to the hard fact that the purpose and benefits of the subsidy had long ago been taken from the common man to reside in the purse of elite few.

“We cannot persist in this imbalance and think it will help us to development. Instead, it is better to end the subsidy and use the funds to establish well-targeted anti-poverty programmes that actually assist the people in need.”

On the contrary, the human rights lawyer, Mr. Femi Falana, disagreed with Tinubu’s position, condemning the Federal Government decision on the price increase and described the action as illegal and immoral.

Falana, a Senior Advocate of Nigeria warned Buhari not to allow the “parasitic ruling class” to hijack his administration.

Like Tinubu, Falana also, in a statement on Thursday, said the hike in the petrol pump price was contrary to the promise made by Buhari to the Nigerian masses while campaigning to be President.

He said by deregulating the downstream sector, the Federal Government was  disobeying a court  judgment obtained by the late human rights lawyer, Bamidele Aturu, against the Federal Government in a suit, marked FHC/ABJ/CS/591/2009.

According to Falana, the court had declared as unlawful the deregulation of the downstream sector of the petroleum industry because it was contrary to the combined provisions of the Price Control Act and the Petroleum Act.

Falana wondered why the Federal Government removed subsidy, after the Minister of State for Petroleum Resources, Dr. Ibe Kachikwu, had recently claimed that the government had scrapped subsidy and was, as a result, saving $1bn and another $1bn on fuel importation.
Why urging Buhari to reverse the increase, which he described as provocative, Falana said, “At this stage President Buhari ought to prevent neo-liberal ideologues from hijacking the administration for the purpose of punishing the Nigerian people for the looting of the treasury and mismanagement of the national economy.

“Contrary to the position of the parasitic ruling class that prices of goods and services be fixed by market forces, the Federal Government has a legal obligation to protect the people from exploitation.

‘‘For instance, the virtual collapse of electricity supply has forced many corporate bodies and individuals to invest heavily in generators and diesel throughout the country.’’

Buhari, APC Chieftains At War Over Boards Appointment; The President Is Selfish - An APC Exco

Buhari, APC Chieftains At War Over Boards Appointment; The President Is Selfish - An APC Exco

Ripples Nigeria - Chieftains and members of the All Progressives Congress (APC) are upbeat about the reluctance of President Muhammadu Buhari to make appointments into federal parastatals as well as Government Ministries, Department and Agencies (MDAs).

Few days to the first anniversary of the administration, the APC bigwigs are displeased that Buhari is yet to overhaul the parastatals and compensate loyal party members with appointments.

The situation, according to those who spoke with Ripples Nigeria under the condition of anonymity, is affecting morale among party members.

They claimed many of their supporters are restive they have not been compensated for the emergence of the current administration.

Buhari, on February 15, sacked 26 Directors-General of federal agencies and parastatals. Those affected include: Nigerian Television Authority (NTA); Federal Radio Corporation of Nigeria (FRCN); News Agency of Nigeria (NAN); National Broadcasting Commission (NBC); Petroleum Technology Development Fund (PTDF); Nigeria Social Insurance Trust Fund (NSITF).

Others were: Nigerian Content Development and Monitoring Board(NCDMB); Federal Mortgage Bank of Nigeria(FMBN); Tertiary Education Trust Fund(TETFund); Petroleum Equalisation Fund(PET); Nigeria Railway Corporation(NRC); Bureau of Public Procurements(BPP) and others.
Over two months after, the hope of APC stalwarts that more heads of parastatals will go has been dashed.

The vacant posts have not been filled either, with the sacked DGs asked to hand over to the highest senior officials in their agencies.

The failure to replace sacked heads and reluctance to relieve more agencies of their leadership, which are handovers of the previous PDP government, are tearing party members apart.

Many of them said they have become agitated by the failure of Buhari to bring fresh hands on board.
One of them, a prominent party executive in the South West, confided: “We are just few days away from the first anniversary and we are still waiting, unsure of what lies before us.

“Many who worked for the success of the party at the state and federal levels have not been compensated or accommodated.

“There are still too many PDP members in places of authorities. One wonders if Buhari realises that APC members are angry with him.”

Another said: “Many of us spent resources and braved the odds to make sure this new administration came on board. But we have not received anything.

“In all democracies, you don’t support a ruling government during elections without getting anything in return. But it appears Buhari is only contented with himself in power. He seems not to care if others who worked for him and the party are taken care of.”

Another, a female from the North, said: “Not having our party members in offices is why this government is suffering. There are too many saboteurs in the system.

“The longer the President keeps them on board, the more damages they will cause him and the nation. The President needs to appease his party members first to win over the nation.”

Investigations revealed that Buhari is taking time to edge out the remaining Directors-General because of the current economic crunch.

A source in the presidency said: “The President is aware that bringing new persons on board will mean incurring higher costs such as accommodation allowance and utility bills. Once the economy rebounds, he will do the needful.”

It was also gathered that Buhari is wary of the wrangling among APC stalwarts over the spoils of office.

The President, it was learnt, is working out modalities on how to minimise the resultant scrambling for posts among party elders.

It was learnt that the President has secretly begun the process of considering who to put in the over 6,000 pending federal appointments.

Edo Guber 2016: PDP Pastor Aspirants Fight Dirty With Colleagues As Things Fall Apart

Ahead of the September 10 governorship election in Edo state, war of words appear to be causing a crack in the Peoples Democratic Party (PDP) family, as some of its aspirants are fighting dirty over who is qualified to fly the party’s flag in the election.
It is pertinent to recall that in their determination to dethrone the All Progressives Congress (APC) in the state, all aspirants of the party had pledged to stick together and work as one family, no matter who emerged as the party’s flag bearer.

But indications that things are beginning to fall apart in the party emerged on Monday when one of the aspirants, Osaro Onaiwu, called on the leadership of the party to call another aspirant, Pastor Osagie Ize-Iyamu, to order over an alleged denigrating statement he made against other aspirants, describing the statement as “unacceptable.”

Onaiwu who was the Director-General of PDP Governors’ Forum, said: “Ize-Iyamu said and we have him on tape, that he is the only one criticizing Oshiomhole, that none of us is doing that. Secondly, that he was the only one that gave N100,000 each to 192 wards during the elections and thirdly, that he is the only person that has the capacity to fight APC and that other aspirants don’t have what it takes.

“But let me remind him: He said he has structures more than three of us, during the last elections, I am from the two Ovia, we were able to deliver the two constituencies for Omosede Igbinedion to win the House of Representatives election. Mathew Iduoriyekemwen is from Ikpoba Okha, he was able to deliver EJ Agbonayinma as a House of Reps member today.‎

“Solomon Edebiri is from Uhumwonde, he delivered Uhumwonde votes. Pastor Ize-Iyamu is from Orhiomwon and our candidate, Larry Ogieva, lost the House of Representatives election. He could not deliver Larry in Orhiomwon. Urhoghide who is a Senator today in Edo South, went to the court because of Oriomnwon votes. So if he says he is the one who can win elections, he should have delivered Orhionmwon for PDP.‎

“Also, don’t forget he is the only aspirant among the four of us who has changed his local government twice. He was operating in Oredo [but] has now moved to Orhionmwon. Is that the kind of person you want us to trust. ‎

“They destroyed PDP in this state but we are trying to build it back. No matter the differences you had in the party you ganged up against it and you are proud to say that you formed the Grace Group to destroy PDP and today you said you want PDP governorship ticket.‎

“You are proud to say that the leadership of the party at that time de-registered you and you went to form ACN, why did you not remain in the ACN that you formed? Why did you not remain with Oshiomhole that you are criticizing? Was it that Oshiomhole was not doing well when you left him? If there are issues with Oshiomhole, go and sort it out and leave the party out of it. Don’t create an impression that you are the only one that can fight APC, we are not going to war and no individual has an exclusive right to violence.

Onaiwu then urged party leaders to call him to order. “The party leadership in Edo state should advise him to campaign about what he wants to do for the people and not destroying other aspirants. He lacks the credibility to think he will lead us to victory. He is creating an impression that he is the only one that can fight Oshiomhole. Running me down, running Iduoriyekenwem and Edebiri down is unacceptable. The party leadership should talk to him. I just pity the party and I expect the party leadership to call him to order.”

‎But in a swift reaction, Pastor Ize-Iyamu said he still stands by the bond of the PDP aspirants, adding that, they are one and that whoever gets the ticket will have their support.

“I never castigated anybody. I have always mentioned what I did for the party at fora where I speak. I never mentioned any aspirant’s name.

“If a man is talking about how he gave money, how is that an offence? I have a right to talk about my contribution to the party. Onaiwu has been talking about how he was DG to Governors’ Forum and what he did, I never reacted to it.

“How I left PDP and came back is in the public domain stand. I stand by our bond and I will never run any aspirant down,” Ize-Iyamu said.

Oyegun's Outburst: PDP Back-down On Saraki, Roots For Ekweremadu, APC Senators Oblige
Barely twenty four hours after the national chairman of the ruling All Progressives Congress (APC), Chief John Odigie-Oyegun, openly declared that the party will not mind if a member of another political party takes over from Senate president, Dr. Bukola Saraki, if he leaves office based on the asset declaration trial, there are indications that the Peoples Democratic Party (PDP) may field Deputy Senate President, Senator Ike Ekweremadu as a likely replacement if there is vacancy.

Daily Sun gathered that some members of the opposition party are thinking in that direction following the body language of the Unity Forum and the Like Minds camps in the Senate.

Members of both camps, who spoke with our correspondent yesterday evening, revealed that they are considering Ekweremadu as a possible replacement for the Senate president, based on his experience and the fact that he has been Saraki’s deputy since last June.

A senator from the South-East who is a member of the kitchen cabinet of the Senate president, told our correspondent that members of Like Minds group, who are predominantly PDP, were already mooting the idea of Ekweremadu succeeding Saraki. He said since it was becoming glaring that Saraki was losing support, both from the party and the Senate, it was time to shop for a senator who will carry everyone along as his possible replacement.

He said though the idea of Ekweremadu succeeding Saraki has not formally been discussed in their regular meetings held at the Maitama residence of Saraki, lawmakers were already throwing their weight behind the Deputy Senate President.

The source said: “We hold meetings everyday and we strategise on the way forward. But many of us were shocked when we read yesterday (Saturday) that the APC was willing to concede the Senate presidency seat to us (PDP). We did not expect it to end like this.

“We have always stood by Saraki and we will stand by him till the end. But we also need to start putting the interest of our party (PDP) first. We have started talking to ourselves and we have started mounting pressure on Ekweremadu to gear up and be prepared to succeed Saraki. He has been the Deputy Senate President for three times now. PDP will take over and Ekweremadu may just be the man.”

In a dramatic twist, the Unity Forum has promised to work with Ekweremadu in the event that he emerges as Senate President. A prominent figure of the forum from the North-West who had a telephone chat with our correspondent yesterday, aligned with the position of the APC national chairman.

He said the forum was ready to work with Ekweremadu if he emerges as Senate President. He argued that it was safer to have an opposition member as Senate President than Saraki, who he said has repeatedly defied the party, APC.

He said: “If Ekweremadu emerges through a democratic means, we will support him. We cannot have our own who is fighting us. We will rather support a stranger that we know than someone who is fighting us from within. We will soon meet and take a position on the next line of action.”

Saraki’s trial is expected to continue today at the Code of Conduct Tribunal (CCT), having failed to get a fresh reprieve from the Federal High Court in Abuja which ruled last Friday that the Senate President should face trial.
