Court Rules Against Suit To Criminalize Extra-marital Sex

Court Rules Against Suit To Criminalize Extra-marital Sex

Court Rules Against Suit To Criminalize Extra-marital Sex
A bid to make all sex outside of marriage illegal was rejected by a top Indonesian court on Thursday.

The court in a ruling that surprised many as concerns grow about rising intolerance in the world’s biggest Muslim-majority country.

Five out of nine judges on the Constitutional Court in the capital Jakarta narrowly rejected the push to criminalize extramarital relations, including gay sex.

The unsuccessful petition would have affected both unmarried heterosexuals and gay people, who cannot marry in Indonesia.

It comes several months after the arrests of a group of men accused of holding a “gay party” and a wave of anti-LGBT rhetoric.

“This is a victory not only for LGBT communities, it’s a victory for common sense,” said gay rights activist Hartoyo, who like many Indonesians goes by one name.

“We live together as a nation and we must respect our differences,” he added.

The court had been hearing a judicial review filed by Islamic activist group the Family Love Alliance that sought to alter the criminal code.

It argued that the influence of the gay community has been spreading, particularly since the United States legalised same-sex marriage, resulting in what it called “moral degradation”.

Activists believe the US decision triggered a backlash in Indonesia, including government ministers publicly making anti-gay statements.

“Of course I’m sad… We know exactly the magnitude of this problem — extramarital affairs and same-sex relationships,” said a weeping Euis Sunarti, who was one of the applicants behind the criminalisation bid.

“Many people will be disappointed with this ruling.”

– ‘Seemingly impossible’ –
In its decision, the court said it had no authority on the matter since passing new laws was the job of Indonesia’s parliament.

“The Constitutional Court cannot intervene in the politics of the penal code,” it added.

But last month, the same court ruled that Indonesia’s native faiths should be recognised by the government.

That ruling challenged a law requiring millions of followers of religions other than six officially recognised faiths to leave the line for religion blank on their national identity cards, limiting their access to public services, including education and medical care, as well as employment opportunities.

Still, some observers were surprised by the court’s decision on Thursday.

“Just when you think this country is rotten, it pulled (off) the seemingly impossible. Hope is here,” writer Alexander Thian said on Twitter.

Indonesia’s justice system is notoriously corrupt and has been criticised for favouring religious-based arguments over legal reasoning in the past.

– Gay sex vigilantes –
Sex is only illegal in Indonesia for both homosexual and heterosexual people if it involves a minor.

However, gay sex is a crime in the conservative province of Aceh, which upholds sharia law, with those caught facing up to 100 strokes of a cane.

Aceh, on Sumatra island, began implementing Islamic law after being granted special autonomy in 2001, an attempt by the central government to quell a long-running separatist insurgency.

This year, two men having sex were caught by a group of vigilantes who raided a boarding house in Aceh.

In May, police arrested a group of men holding a party in two hotel rooms in Surabaya, Indonesia’s second-biggest city.

Some of the men were watching gay porn and performing “deviant sexual acts”, police said, charging some under Indonesia’s tough anti-pornography law, which can result in long jail sentences.

Outside Aceh, Indonesia’s current laws on homosexuality are more liberal than some of its neighbours, however.

In Singapore sex between men remains illegal, a holdover from colonial rule that is not strictly enforced. In Malaysia sodomy is a criminal offence and can result in imprisonment, corporal punishment, and fines.

Indonesia has often been praised for its moderate inclusive brand of Islam.

Still, the diverse archipelago’s sizeable religious minorities — mainly Christians and Muslim minority Shiites and Ahmadis — have been increasingly targeted in recent years.

Marital Tragedy: How Ex-FCMB Boss, Ladi Balogun's Marriage CRASHED Abruptly

Marital Tragedy: How Ex-FCMB Boss, Ladi Balogun's Marriage CRASHED Abruptly

Ladi Balogun and Wife
Bliss deserted Ladi Balogun’s marriage in unexpected hours, like a crushed knight fleeing the gates of a fallen fortress. To the former Managing Director (MD) of First City Monument Bank (FCMB), the love that warmed the inner cockles of his heart soon became the thorn that pierced his lungs while he inhaled the fragrance of passion. Thus his marriage to Banke crashed irredeemably, while they were busy doing other things.

The couple certainly fell out of love, forgetting that where there is no love, there is no ardour. They simply stopped tolerating each other. They could no longer bear to live as man and wife while their passion subsided and their home became a wretched cove of distrust and hatred.

Sources close to the estranged couple revealed that their marriage crashed due to irreconcilable differences.
Banke allegedly refused to play second fiddle to Ladi. She was not submissive and couldn’t fulfill the role of dutiful wife, friend, lover and confidant to her husband, according to Ladi’s apologists.

On the other hand, Banke’s friends argued that her mother-in-law (Ladi’s mother), had too much influence on him. They claimed her influence on her son contributed in no small measure to the short-lived marriage.

And contrary to belief that the marriage recently hit an iceberg, the couple allegedly separated from each other a long while ago but they succeeded in keeping it under wraps to avoid the noise and scandal that could result from undue media exposure.

While no one is sure if they would ever reconcile and remarry, it is an open secret that the couple are happy without each other. Ladi, for instance, is having the time of his life. He allegedly drinks more and hangs out more now.
It is however, astonishing to note that while some of Banke’s friends are up in arms in defense of their friends, many of them are jostling to replace Banke in her estranged husband’s house. Each of them desperately seeks to become the new Mrs. Balogun, according to The Capital findings.

Despite her posturing, Banke would definitely hurt and bleed from the sting of losing her home to a treacherous friend. When she tied the nuptial knots with her groom, Ladi, she didn’t know what grief would spring from their union. By the time reality dawned on her, it was too late to save her marriage

Speaking with the Punch Newspaper, the former lawmaker said he decided to marry another wife because he was alone and needed a companion.

Nunieh officially married a lady in her 40s on Tuesday at the Presidential Hotel in Port Harcourt, the Rivers State capital, Punch Newspaper reports

The former member of the National Assembly, who said he was now a king in Ogoniland, River State, explained that he had been alone after his former wife died in 1991.

Speaking with our correspondent on the telephone  on Tuesday, Nunieh pointed out that his children were all adults, who had ventured into various business of their own, adding that he could no longer cope with loneliness.

He described his new wife, Rosemary, as an intelligent woman, who would always be there for him and share ideas with him.

“I cannot continue to stay alone. I love her and she loves me. We understand each other and she is also intelligent. In marriage, there are advantages somewhere and disadvantages in other areas.

“There is no limitation in age. Some may say you are old; you may soon die. But some were dead even before they were born. Some were one year or two years old and they die. Death is not always dependent upon a man’s age,” he said.

About her new wife, Nunieh said, “You know that rose is the best of all flowers and we have two Marys in the Bible; we have Mary, the mother of Jesus and Mary Magdalene.

“She too (Rosemary) is a believer of the Bible. But why are you particular about her age? She is not an infant. She is a very charming woman.”
